1. The service
Mercestack provides business workspace software for structure, work, customers, communication, finance, commerce, automation, websites and AI-enabled operations. Features may vary by plan, workspace configuration, geography and connected provider.
2. Accounts and authority
You must provide accurate account information, protect your credentials and promptly report suspected unauthorised access. If you use Mercestack for an organisation, you confirm that you have authority to bind that organisation. Workspace owners control membership, permissions, modules and customer content.
3. Acceptable use
You may not use the service to break the law, infringe rights, distribute malware, send unlawful or unsolicited communications, bypass access controls, probe other tenants, interfere with service operation or create material risk for Mercestack or others. You are responsible for ensuring that your collection and use of customer content is lawful.
4. Customer content
You retain rights in content submitted to your workspace. You grant Mercestack the limited rights necessary to host, process, transmit, back up and display that content to provide and secure the service. You are responsible for content accuracy, permissions, notices and retention obligations.
5. Connected services and AI
Third-party providers have their own terms and availability. You authorise Mercestack to exchange the data needed for features you connect or invoke. AI and automation can produce incorrect or unsuitable results; configure permissions and approvals appropriately and review consequential actions.
6. Plans, billing and taxes
Paid plans renew according to the billing interval shown at checkout until cancelled. Prices, limits, applicable taxes and any prorated amount are presented before payment. Failed payments may result in a grace period, restricted modules or suspension. Except where law requires otherwise, fees already earned are not refundable.
7. Suspension and termination
We may restrict or suspend access when payment is overdue, use creates security or legal risk, or these terms are materially breached. You may cancel through available account controls. Following termination, access ends and customer content may be deleted after the applicable retention period, subject to legal and backup requirements.
8. Availability and changes
We work to keep Mercestack reliable, but the service is provided without a promise of uninterrupted or error-free availability. We may improve, replace or discontinue features and will seek to provide reasonable notice when a material change adversely affects active customers.
9. Intellectual property
Mercestack and its licensors retain rights in the service, software, design and documentation. These terms grant a limited, non-exclusive, non-transferable right to use the service during an active account; they do not transfer ownership.
10. Disclaimers and liability
To the extent permitted by law, the service is provided “as is” and implied warranties are disclaimed. Mercestack is not responsible for indirect, incidental, special or consequential loss, lost profits or loss caused by customer configuration or third-party providers. Any liability that cannot legally be excluded remains limited only to the extent permitted by applicable law.
